The Tennis Hits the USA! Sweepstakes (“Sweepstakes”) is sponsored by Midwest Sports, LLC dba Midwest Racquet Sports (“Sponsor”). The Sweepstakes is not sponsored, endorsed, supported, or administered by Instagram, Facebook, Twitter, ATP Tour, Signa Sports United.
The Sweepstakes starts at 12:01 AM EST on March 15, 2022 and ends at 12:00 PM EST on April 11, 2022 (“Sweepstakes Period”).
To be eligible to enter the Sweepstakes, you must be an individual who is a legal resident of the United States of America and be at least eighteen (18) years of age at the time of entry.
VOID IN ANY JURISDICTION WHERE PARTICIPATION IS PROHIBITED. All federal, state, and local laws and regulations apply.
By entering the Sweepstakes, you represent and warrant to Sponsor that you meet these criteria. You further represent and warrant that your participation in or attempted participation in the Sweepstakes does not violate any federal, state, or local law or regulation that governs your entry into the Sweepstakes.
Employees of SIGNA Sports United and its parents, subsidiaries, and affiliated companies and of Midwest Sports, LLC dba Midwest Racquet Sports and each of their immediate family members (spouses, parents and their spouses, children and their spouses, and siblings and their spouses), agents, and representatives are not eligible to enter in or win the Sweepstakes.
To enter for a chance to win a prize in the Sweepstakes simply do any one of the following.
(a) ONLINE: Visit https://www.tennis-point.com/us-atp/a/usatp/, enter a valid email address, and click the box to confirm that you are eighteen (18) years or older. Following those steps constitutes an entry (“Entry”).
(b) BY MAIL: Send a letter or post card to Midwest Racquet Sports attn: ATP Sweepstakes, 11613 Reading Road, Cincinnati, Ohio 45241 with your name, address, telephone number and the words “Tennis Hits the USA! Sweepstakes” Mail-in Entries must be postmarked during the Sweepstakes Period and must be received by Sponsor on or before March 30, 2022. Mail-in Entries will be considered to be submitted as of the date on the postmark on the entry card. Mail-in Entries that are not postmarked will not be entered into the Sweepstakes.
No other method of entry will be accepted. Only one (1) Entry per eligible individual is permitted no matter how the Entry is submitted (whether online or mail-in). Individuals entering or attempting to enter more than once will be disqualified. Mass entries generated by a script, macro, or use of automated devices will be disqualified.
Sponsor is not responsible for incorrect, inaccurate or incomplete entry of information by entrants; lost Entries or transmissions; interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human or electronic, technical malfunctions or the computer hardware, software, or any combination thereof; problems associated with any virus or other damages caused to entrants’ system, or any loss or delays caused by USPS or any mail carriers used to submit mail-in Entries . All Entries will become the sole property of Sponsor and cannot be returned.
BY ENTERING THE SWEEPSTAKES, YOU AUTHORIZE SPONSOR TO SHARE AND USE THE INFORMATION YOU SUBMIT WITH YOUR ENTRY FOR PURPOSES UNRELATED TO THE SWEEPSTAKES. To opt‐out of receiving any newsletters or promotional materials from Sponsor send an email message to [Service@tennis-point.com] or letter to Midwest Racquet Sports Attn: Customer Care, 11613 Reading Road, Cincinnati, Ohio 45241.
The Sweepstakes will have one (1) winner (the “Winner”) who will receive one (1) $500.00 gift card to Midwest Racquet Sports (the “Prize”). The retail value of the Prize is $500.00.
THE PRIZE IS NOT TRANSFERABLE, AND ALL FEDERAL, STATE, AND LOCAL TAXES ASSOCIATED WITH THE PRIZE, AND ANY COSTS AND EXPENSES ASSOCIATED WITH THE PRIZE, ARE THE SOLE RESPONSIBILITY OF THE INDIVIDUAL WHO WINS THE PRIZE.
No substitution of Prize or transfer/assignment of Prize to others or request for the cash equivalent of Prize by Winner is permitted.
On or about April 11, 2022 at 1PM ET one (1) Entry will be selected randomly in a drawing from all eligible entries submitted. The odds of winning the Prize depend on the number of eligible Entries received.
The Winner will be notified by April 5, 2022 via the email address or telephone number provided in her or his Entry (“Winner Notification”) that she or he has won the Prize. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the Winner Notification.
The award of the Prize to the Winner will be conditional on the Winner indicating to Sponsor within three (3) days of and in accordance with the instructions set forth in the Winner Notification that she or he is willing to accept the Prize. The award of the Prize to the Winner will also be conditional on the Winner submitting a Winner’s Declaration (defined below) to Sponsor in accordance with the instructions set forth in the Winner Notification.
If the Winner does not indicate she or he is willing to accept the Prize within three (3) days of Winner Notification, refuses to submit a Winner’s Declaration (defined below), or is otherwise ineligible, the Prize may be forfeited and awarded to an alternate entrant who will be selected from the remaining eligible Entries at the sole discretion of Sponsor.
The Prize will be sent via UPS, USPS or FedEx to the confirmed Winners within ten (10) days of Winner Notification, provided that all requirements set forth in these Official Rules have been met.
Sponsor is not responsible for its inability to contact a Winner or deliver the Prize due to change of the Winner’s email address or telephone number. If an entrant’s email address or telephone number changes between the time she or he enters the Sweepstakes and the drawing date, it is the sole responsibility of the entrant to notify Sponsor of such change.
In the event of a dispute over the identity of a Winner who entered online, the Winner will be deemed to be the Authorized Account Holder of the email address supplied with the Entry. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
The name of the Winner will be posted at Midwest Racquet Sports.com within thirty (30) business days after the end of the Sweepstakes Period. Alternatively, to receive a paper copy of the names of the Winner, send a letter to Midwest Racquet Sports ATTN: ATP Sweepstakes 11613 Reading Road, Cincinnati, Ohio 45241 asking for same and include a self-addressed, postage pre-paid envelope with the letter. The information will then be mailed within a reasonable time after the Sweepstakes Period ends.
Unless prohibited by law, the Winner will be required to sign and complete a Declaration of Eligibility/Liability and publicity grant (“Winner’s Declaration”), which will include consent to the use of the Winner's name, voice, and/or likeness for the purpose of advertising, trade, or promotion without further compensation worldwide in perpetuity and in any form of media including the Internet. The Winner’s Declaration must be returned to Sponsor within five (5) days of Winner Notification.
By participating or attempting to participate in the Sweepstakes, even if ineligible, you release, indemnify, and hold harmless Sponsor, its parent companies, affiliates, subsidiaries, legal advisors, and all related individuals and entities, as well as Facebook, Twitter, Instagram and their directors, officers, employees, agents, and independent contractors, (collectively, the “Released Entities”) from any and all liability, costs (including attorneys’ fees), losses, damages (including punitive, incidental, consequential, and special damages and lost profits), claims (including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy), or actions of any kind arising out of or relating to the Sweepstakes in any way, including, but not limited to, (1) entrants’ participation in the Sweepstakes; (2) any errors in evaluating the eligibility of entrants; (3) any acceptance, possession, ownership, misuse or use of the Prize or items purchased with the Prize; (4) any typographical, mechanical, technical, programming, human, or other error or malfunction in the printing, offering, selection, operation, or announcement of the Sweepstakes and/or the Prize; (5) any technical malfunctions of the computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by Sponsor; and (6) any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects, and/or any other errors or malfunctions, even if caused by the negligence of the Released Entities.
By participating in the Sweepstakes, entrants agree to be bound by these complete Official Rules and by the decisions of Sponsor which shall be final and binding in all respects. Any disputes relating to the Sweepstakes arising between entrants or attempted entrants and Sponsor shall be submitted to the federal, state, and local courts located in Cincinnati, Ohio and resolved under the laws of the State of Ohio.
Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules, including by, and without limitation, in its sole discretion, disqualifying any person tampering with the entry process, the operation of Sponsor’s website, or who is otherwise in violation of these Official Rules.
The invalidity or unenforceability of any provision of the Official Rules or Winner’s Declaration will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or Winner’s Declaration is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules.
Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.
Sponsor reserves the right to cancel, terminate, or modify the Sweepstakes without notice. In the event of cancellation, the Prize may be awarded by random drawing of the eligible entries received prior to the date of the cancellation or not awarded at all, at Sponsor’s sole discretion.
